NH Union Evergreen Clause

FYI on the Unions Evergreen Clause that they are crying about here in NH "The Massachusetts Supreme Court has issued a decision that invalidates most contract extension provisions (so-called “evergreen clauses”) which appear quite often in public employee collective bargaining agreements. See Boston Housing Authority v. National Conference of Firemen and Oilers, Local 3, SJC-10569 (Oct. 22, 2010)."

First Female VP Candidate Ferraro Dies At 75

Whether you disagreed like I did or agreed with Geraldine's politics, you have to admit she stood up for what she believed in and I had a lot of respect for her. My condolences go out to her family and they are in my prayers.

Baldasaro didn't break any laws at the polls

LONDONDERRY — While some objected to "electioneering" by Rep. Al Baldasaro, R-Londonderry, at the polls March 8, he was within legal boundaries.

Baldasaro made copies of the town and school district's ballot on 5-by-11-inch card stock. He then filled in his choices for Town Council, Budget Committee, Trustee of Leach Library, Trustee of the Trust Funds and School Board. He also checked off "yes" on the article as proposed by the Charter Commission, of which he was a member, that would decide if the town went to ballot-style voting beginning next year, ending the traditional Town Meeting.

"It's all legal," Baldasaro said. "It's a paid ad."  Read More

LETTER TO THE EDITOR ON THE REBUTTAL TO SUPERINTENDENT PRESS RELEASE 3-20-2011

Per Superintendent Nate Greenberg’s Press Release comments last week, "It is unfortunate that the petitioners could not seek other options to this issue of the quorum". Mr. Greenberg’s Press Release contradicts the response from the School Board meeting on September 28th where Mr. Greenberg stated, “since this is an existing charter, a court would have to decide about the quorum or a question would have to be placed on the ballot.”  There were no other options and School Board Member Steve Young reiterated that by stating, “if it is challenged in the deliberative session that is one time line, but if there is a question on the ballot and the townsfolk uphold the quorum there is still the question of whether it is legal.”  [Londonderry School District School Board; Minutes, Tuesday, September 28, 2010].

I wrote the Attorney General and obtained an legal opinion and we showed the School Board the Attorney General’s letter which was signed off by the Secretary of State and the Department of Revenue.  Charter Commissioner Steve Young was present when the Assistant secretary of State and Towns Attorney said the quorum was illegal. Therefore, our answer from the school board was that a determination must be made by the courts regarding the legality of the quorum, what options did we have besides going to court?

Our Attorney sent a letter to Superintendent Nate Greenberg and Moderator John Michaels asking them to stop the illegal quorum and gave them 10 days to come up with a working solution to the illegal quorum and they refused. The School district, School Board and the School District’s Attorney were the only ones stating that the quorum was legal and they decided to stand by the illegal vote. If you knew at the time of your past ballot votes that the quorum was unconstitutional, would you have voted for the quorum?

I can tell you that I left the quorum question on the ballot blank last year because I felt it was not right.

The School District wants you to think, that we could have done a Citizen's petition. That is not true, because it would have required forcing another illegal vote on the quorum question.

In my opinion, it is time to move on and I ask that district to not come up with excuses that we could not or did not try to work with the School District when they refused to take responsibility for endorsing an illegal quorum.

Senator Carson and I will work together to find a bill that we can amend to fix the default budget issue. I will not file any legislation that puts a quorum in place, which steps on Voter’s Rights at a Deliberative session.
For many years, US Supreme Court/NH Supreme Court made many decisions protecting Voter’s Rights and we should never give up one inch of our Freedom.

"The Constitution is not an instrument for the government to restrain the people; it is an instrument for the people to restrain the government -- lest it come to dominate our lives and interests."
Patrick Henry

The court has spoken and I am in hopes that the School District moves on in the best interest of the whole town and our Constitutional Right to Vote.

I do want to thank the many residents who stood by Former Councilor Brian Farmer, Town Councilor Chairman Sean OKeefe and me for standing up in protecting our Constitutional Right to vote.

Kathy Has Some "Splainin" to do by Jim Loiselle

Kathy, "can you explain to me, as I am confused, how asking for court review of the quorum question relates to a plan to "reduce" the school budget."

Jim,
Thanks for posting this and I thank you for your sincere comments.

I was going to post this letter but you beat me to it!!!

Kathy has lost all credibility with many in town who have read her letter of deceit to the Tax Payers in hopes to get the usual feel bad for the kids mentality that comes out of many School Districts and Legislators to get people to support throwing more dollars at the schools.

I am really ashamed at her for sending out lies throughout our community and Kathy Wagner owes Brian, Sean and myself an apology for this bull.

We have never said we wanted a flat tax, or distorted the truth, but expressed our opinion on an unconstitutional quorum. Because we disagree with Kathy, she is spreading falsehoods about us. The people will decide what happens with the budget not us.

Knowing Kathy, I won't hold my breath waiting.

It's a shame that the School Supporters of the quorum would stoop this low!!!

Shameful,

AL

NH workers would not have to join union under bill
Boston Globe
"State Rep. Al Baldasaro, a Republican from Londonderry and bill co-sponsor, said the fee requirement was extortion."

"State Rep. Al Baldasaro, a Republican from Londonderry and bill co-sponsor, said unions should not force workers to give up their money by telling them they can't work there otherwise.

"It's extortion. It has to stop," he said.

Baldasaro said workers should be able to negotiate individually with companies. If they don't want to be part of a union, they should not get any union services, he said."

However, "New Hampshire Gov. John Lynch told a House committee Thursday he opposes an anti-union right-to-work bill that would end the practice of requiring nonunion members to pay a share of collective bargaining costs."

Saturday, January 15, 2011

"Before a legislative committee Thursday, Attorney General Michael Delaney said he opposes House Bill 89 mandating that he join a lawsuit, brought by Florida and several other states, challenging the federal health care act. The suit claims the federal law is unconstitutional because it requires people to buy health insurance.

Delaney told the House Federal Relations and Veterans Affairs Committee that the bill violates the separation of powers doctrine in the New Hampshire Constitution and the long-standing tradition of an independent attorney general.

But bill sponsor Rep. Kenneth Weyler, R-Kingston, said joining one of the suits "seems like such an obvious thing. We should not allow this. But the attitude of the (attorney general) was less than stellar (with him) saying 'I don't have to do what you say.'""...

"Delaney was appointed by Gov. John Lynch, a Democrat."

"Committee chairman Rep. Alfred Baldasaro, R-Londonderry, also was upset with Delaney. He said lawmakers pass laws all the time that the attorney general disagrees with, but he has to do what's in the best interest of the people."

"This is a budgetary issue that will cost the state of New Hampshire millions of dollars for years to come. The attorney general has to look out for the people of New Hampshire; that's his job. If he can't do it, we will get somebody who can," Baldasaro said."

Out of Control Minority in Concord - LondonderryNH.net

"Then there is the bill sponsored by Rep. Steven Lindsey (D) urging the United Kingdom to return the Elgin Marbles to Greece. You know, my neighbor and I were talking just the other day about this, wondering when we'd get some local legislative action on getting those marbles home. Seriously, before you criticize Republicans for filing frivolous legislation you should move out of the glass house.

Meanwhile, you have the aforementioned Ms. Sullivan lambasting Rep. Al Baldasaro for a proposed constitutional amendment. If you ever need a clinical definition of a straw man argument you will find none better than this. If anyone can locate references to the Pledge of Allegiance, the Fourth of July, or secession in Al's bill be sure to let me know.

And how about this gem. Enrique Meza, a Manchester immigration attorney and head of Governor Lynch's Advisory Commission on Latino Affairs was recently quoted regarding the Hispanic population in New Hampshire, "Some of us are legal. Some of us are illegal…we're here to stay!"

New Hampshire voters elected a legislature to reflect their views. Now we have the left intimating that these same representatives are out of control and are out to destroy our state." Read More

O'Brien Wins Republican Caucus, Will Become Next Speaker of NH House

The House Republican Caucus, who on November 2 took a historic edge in the New Hampshire House of Representatives with 298 members, today elected Rep. William O'Brien of Mont Vernon as their designee to become the Speaker of the House in the 162nd session of the NH General Court.

"I'm looking forward to working with Republicans and Democrats in the New Hampshire House to fulfill the mandate for a new direction that the people of New Hampshire voted for on November 2," stated O'Brien, an attorney by trade and recently elected to his third term.

Rep. O'Brien, who campaigned on a platform of openness among the caucus, will be holding a caucus after the December 1 organization of the new House of Representatives to elect a majority leader.

Who is Representative Al Baldasaro?

I am a Candidate seeking my third term as your State Representative, representing the towns of Auburn & Londonderry. As your State Representative, my voting record speaks for itself.  I am proud to serve you as a loud voice in Concord , one who will continue to look out for your wallets and keep government out of your homes.

I am a straight talking person, one who will tell it like it is and I know I can't make everyone happy. We will not agree on all of my votes but at least you know up front where I stand on issues that affect you and if you don't know, you may ask me.

As I have stated many times, I want to ensure New Hampshire stays a "Live Free or Die" state and where we maintain the NH Advantage. I'll continue to vote to protect our quality of life. I don't support an income tax or a broad base tax. I will continue to fight the Democrats on bringing back parental notification and fight for the protection of our children from child molesters.

I will continue to support Londonderry & Auburn in getting their fair share of the Adequacy Education funding, along with a constitutional amendment to ensure Local Control of education decisions. Londonderry is scheduled to lose 1.7 Million and Auburn is scheduled to loose 167,000 dollars. I believe the money should follow the child. I will continue to look out for my constituents on the Adequacy Education formula along with the $41 Million in Education Stimulus that came to NH, with many mandates to ensure that the TAX PAYERS are not left paying for all the mandates.

For your information, I do not plan on putting any bills in that will take from the Tax Payers of NH but I do plan at looking at how we can repeal the many taxes and fees that were voted in by the Democrats, like repealing bill that raised the Motor Vehicle registration fees. I will also ensure that Londonderry and Auburn get their fair share of the Rooms & Meals Tax, repeal the Business Enterprise Tax (BET), repeal the Evergreen Clause and that our schools get their fair share of the education Adequacy funds.

We are fortunate here in NH because we do not have a revenue problem; the Governor/Democrat controlled Legislature has a spending problem. That needs to be stopped!  I will continue to be a loud voice on the bloated revenue projections that the Democrats used to justify their over 27% hike in spending in the last 4 years.

I will continue to be an Advocacy for lower taxes and less spending, smaller, more efficient constitutional government, family's right to keep government out of family decisions, fundamental and 'individual" right to keep and bear arms, protect family through educational choice with charter schools and vouchers and support for home schooling, protect the children with Special Needs along with local control of education.

I will never change my views where I believe that U.S. and N.H. Constitutions are a check on governmental power and an expansion of personal liberty. Government expansion does not enhance freedom and liberty, rather, government curtails it, religious freedom is a fundamental right and I believe marriage is between one man and one woman.

I will continue to protect the 10th amendment of the U.S. constitution which is being overstepped and I stand by the best kind of government, is a government that is of the people.

If you need more information on me, check out www.baldasaro2010.com .

If you should have any questions, please do not hesitate in calling me at 425-6997 or e-mail me your questions at mbaldasaro@comcast.net.

Together we will continue the fight to ensure NH is the best state in the country to raise a family and with your help we can make that happen. I ask for your support and vote on November 2nd, so I can continue to be a loud voice for the business's and families of NH.

Thank you,
